The New York Matrimonial Trial Handbook 2d Edition (Bookbaby, 2024) by Joel R. This handbook is a companion to his 12-volume treatise, Law and the Family New York, 2024-2025 Edition (Thomson Reuters), which contains extensive coverage of the New York law dealing with matrimonial actions and family court proceedings.

The New York Matrimonial Trial Handbook, 2d Edition, focuses on the procedural and substantive law, as well as the law of evidence, that an attorney must have at his or her fingertips when trying a matrimonial action and custody case. It is intended to be an aid for preparing for a trial and a reference for the procedure in offering and objecting to evidence during a trial. The book deals extensively with the testimonial and documentary evidence necessary to meet the burden of proof. There are thousands of suggested questions for the examination of witnesses at trial to establish each cause of action and requests for ancillary relief, as well as for the examination of experts and cross-examination of difficult witnesses.

This Second Edition includes changes in the law and important cases decided by the New York courts since the First Edition was published in 2017. It is current through September 1, 2024. It contains additional questions for the examination of witnesses, and covers the recent revisions to the Diagnostic and Statistical Manual of Mental Disorders (DSM-5 TR) and the new APA Guidelines for Child Custody Evaluations. 

The New York Matrimonial Trial Handbook, 2d Edition was written for the attorney who has never tried a matrimonial action or custody case, as well as for the experienced lawyer. The handbook includes all of the questions counsel must ask their client and expert witnesses at trial to establish a prima facie case for divorce, maintenance, child support, property distribution, exclusive occupancy, custody, and counsel fees. It also includes all of the questions counsel must ask on the direct examination of a business valuation expert, a pension expert, a real estate appraiser, a court-appointed psychiatrist or psychologist, and a forensic expert in a custody case.

About The Author


Joel R. Brandes, of the New York Bar, is a member of the Law Firm of Joel R. Brandes, P.C. in New York, New York. He concentrates his statewide practice on appeals in divorce, equitable distribution, custody, and family law cases and serves as counsel to attorneys with all levels of experience assisting them with their difficult appeals and litigated matters. Mr. Brandes has been recognized by the New York Appellate Division as a ''noted authority and expert on New York family law and divorce." He is the author of Law and The Family New York, 2024-2025 Edition (12 volumes), Law and the Family New York Forms, 2024 Edition (5 volumes) (both Thomson Reuters), as well as their previous editions, and the New York Matrimonial Trial Handbook (Bookbaby). He has written and lectured extensively on divorce and family law, and international child abduction. He is the author of "Law and the Family", a regular monthly column in the New York Law Journal, and a frequent contributor to the New York State Bar Association, Family Law Section, Family Law Review. He has authored more than 600 published legal journal articles.
